Lessee’s Information: As stated in the “Personal Data” section.
1.The purpose of this contract is the leasing of the goods described in the “Rental Details” section.
2.A security deposit of €50 for each classic bicycle and €200 for each electric bicycle is required, to be paid by credit card (cash deposits are not accepted), which will be unblocked upon return of the equipment once its condition is checked.
3.The rental period specified in this contract is confirmed once payment and the deposit have been made. The bicycles and any optional rented equipment will be collected and returned at the place, date, and time agreed in the contract.
4.Early returns: No refund will be issued for returning the bicycle and rented equipment before the end of the contracted rental time.
5. Cancellation Policy:
5.1. Bike Rentals:
- Urban Bike Rental: Free cancellation up to 24 hours before.
- Mountain and Road Bike Rental: Free cancellation up to 7 days before; 100% charges thereafter.
5.2. Small Group Guided Tours:
- Free cancellation up to 24 hours before.
5.3. Private Bike Tours:
- Free cancellation up to 30 days before.
- 50% charges up to 7 days before.
- Less than 7 days: 100% cancellation charges apply.
5.4. Private Walking Tours:
- Free cancellation up to 30 days before.
- 50% charges up to 7 days before.
- Less than 7 days: 100% cancellation charges apply.
6.Late returns will incur an additional cost on top of the rental price of €30 per hour or fraction of an hour of delay, with a maximum of €100/day. In case of failure to return the rented equipment within 24 hours from the agreed time, it will be considered as not returned due to loss or theft, and the Lessee shall fully assume the cost of replacing the rented equipment according to the terms of this contract.
7.In case of theft or loss of the rented equipment, including failure to return it within 24 hours after the rental period ends, the Lessee must pay the total amount according to the sale price. The selling price of the equipment can be checked on the Lessor’s website (www.bilkebilbao.com) or at the customer service point.
8. In order to prevent theft, the Lessee is always obliged to securely lock the bicycles to fixed points using the lock provided.
9.The leased bicycles and accessories are delivered in perfect condition and working order. The Lessee must have sufficiently checked them and return them in the same condition. If any defects are found, they must be expressly noted in the “Observations” section at the time of signing the contract.
10.The rented equipment must be returned complete and in the same condition as when delivered. The Lessee shall be responsible for the cost of any damage to the bicycle or other rented equipment and must inform the Lessor of any damage or malfunction before leaving the premises and must bear the full cost of the necessary repairs and/or replacement, and any lost profits. The condition and status of the rented equipment and any losses and/or damages caused will be determined at the time of return.
11.This contract is a personal obligation of the Lessee and cannot be assigned, transferred, subrogated, loaned, or sold, either for consideration or for free, to any third party, and the use of the rented equipment by a third party other than the Lessee is strictly prohibited.
12.The Lessee is aware of the risks involved in cycling and will be solely responsible for any damage caused to themselves or their group, third parties, or any property, movable or immovable, resulting from normal or abnormal use of the bicycle. The Lessor assumes no responsibility for non-regulatory driving or for any occasional accidents, either for own damages or third-party damages.
13. The following are prohibited:
-The disassembly and/or partial manipulation of the bicycle or other rented equipment.
-Cycling under the influence of alcoholic beverages or toxic substances.
-Failure to comply with traffic regulations.
-Use of the bicycle in inappropriate terrain or conditions, such as stairs, slopes, ramps, etc.-Use the bicycle for the transportation of passengers or goods.
-Park the bicycle without supervision or necessary safety measures.
14.The Renter declares, under their own responsibility, to be in perfect health conditions, capable of handling a bicycle, and possessing control of the rented equipment.
15.In compliance with the Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, we inform that the data provided by the customer (Renter) will be used for the correct provision of the contracted service, and may request, in accordance with the law, access, rectification, cancellation or opposition by any means to the lessor.
16.At BILKE BILBAO, S.L., we process the information provided to us in order to provide the requested service and carry out billing. The data provided will be kept for as long as the commercial relationship is maintained or for the time necessary to comply with legal obligations and address any potential liabilities that may arise from the fulfilment of the purpose for which the data was collected. The data will not be transferred to third parties except in cases where there is a legal obligation. You have the right to obtain information about whether BILKE BILBAO, S.L. is processing your personal data, so you can exercise your rights of access, rectification, deletion, and portability of data and opposition and limitation to its treatment before BILKE BILBAO, S.L., C/ Juan de Ajuriaguerra 21, 48009 – Bilbao or by emailing admin@bilkebilbao.com, attaching a copy of your ID or equivalent document. Likewise, and especially if you consider that you have not obtained full satisfaction in the exercise of your rights, you may file a complaint with the national control authority by addressing the Spanish Data Protection Agency, C/ Jorge Juan, 6 – 28001 Madrid.
17.We also request your authorization to offer you products and services related to those contracted and to retain you as a customer.”

18.BILKE BILBAO, S.L. has contracted liability insurance that covers any damage that could be caused by breakdown or intrinsic failure of the rented material.
19.In case of any discrepancy in relation to the interpretation and/or compliance of the contract, the parties expressly submit to the courts and tribunals of Bilbao.
